Verse 19 of Surah An-Nisa is a key Quranic evidence in family law. The interpretation of the phrase "You are not permitted to inherit women against their will" has been disputed among exegetes and jurists. This disagreement originates from differing literary and grammatical analyses, particularly regarding the syntactic position of the adverb "karhan" (forcefully) and the semantic scope of the verb "tarthū" (inherit). According to the first view, based on the occasion of revelation, "tarthū" means to inherit women themselves, with "karhan" describing the women's state of coercion. This leads to the jurisprudential ruling prohibiting forced marriage and emphasizing the necessity of the woman's consent. In contrast, a context-oriented reading interprets "tarthū" as referring to control over women's property, with "karhan" describing the heirs' aversion. This infers a general rule prohibiting coercion and financial-emotional abuse of women within the family. This study analyzes the literary-syntactic foundations of this interpretive difference and its jurisprudential consequences, employing a descriptive-analytical method. It examines the classical, revelation-based perspective and the contemporary, context-focused reading. The findings indicate that the two readings are not contradictory but represent complementary levels of meaning. A precise grammatical analysis thus allows utilizing the verse's enduring potential to derive dynamic rulings responsive to emerging issues in family jurisprudence.
